Terms of Service

These Terms of Service ("Terms") govern your use of the SPARKIT API ("Service") and the sparkit.science website.
1. Acceptance
By creating an account or making API calls, you agree to these Terms.
2. The Service
SPARKIT provides a programmatic interface to a deep-research agent that retrieves and synthesizes the relevant literature, performs analyses where the question requires them, and returns structured Markdown reports. The Service is currently in beta and may change without notice.
3. Account responsibilities
You are responsible for:
- Keeping your password and API keys confidential
- All activity under your account
- Providing accurate billing information
- Promptly notifying us of unauthorized use
4. Acceptable use
You agree not to:
- Use the Service for unlawful purposes
- Attempt to reverse engineer, scrape at scale, or bypass quotas
- Submit content that infringes others' rights
- Submit content designed to extract personal data about identifiable individuals
- Resell raw API access without an appropriate agreement
We may suspend or terminate accounts that violate these rules.
5. Plans and billing
- Try-it is a one-time, non-recurring purchase of 5 research queries that expire after 30 days.
- Plus, Pro, and Max are billed monthly under an initial 12-month commitment. Usage above the included monthly quota is billed at the per-query overage rate listed at sparkit.science/pricing.
- Paid subscriptions automatically renew for successive 12-month commitment terms unless you schedule cancellation before the current term ends.
- You may schedule cancellation at any time. Service and monthly billing continue through the current commitment end date, then the subscription ends. Cancelling a subscription does not close your SPARKIT account.
- All fees are non-refundable except where required by law.
- We may change prices with 30 days' notice; existing pricing applies through your current commitment term.
6. Intellectual property
- We own the Service, the SPARKIT software, and our trademarks.
- You retain ownership of the questions you submit and any reports we return to you. You grant us a non-exclusive license to process them for the purposes described in our Privacy Policy.
- We do not use your queries or returned reports to train any model.
7. Disclaimers
The Service uses large language models and external search providers. Outputs may be inaccurate, incomplete, or biased. Do not rely on SPARKIT outputs for clinical, legal, financial, or other high-stakes decisions without independent verification.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8. Limitation of liability
To the maximum extent permitted by law, SPARKIT and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Aggregate liability for any claim is capped at the amount you paid for the Service in the 12 months preceding the claim, or $100, whichever is greater.
9. Indemnification
You agree to indemnify SPARKIT against claims arising from your use of the Service, your content, or your violation of these Terms.
10. Termination
You may request account closure at any time by emailing the address below. Closing an account does not eliminate payment obligations already incurred under an active commitment. We may suspend or terminate accounts for violations of these Terms or as required by law.
11. Changes
We may update these Terms. Material changes will be announced on sparkit.science/blog or by email. Continued use after changes constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in courts located in San Francisco County, California.
